Terms of service

The terms that govern using Harvinfra.

These terms apply to visitors of this website and to customers using the product under a subscription. If a signed order form is in place, it takes precedence where the two disagree.

1. Acceptance

By using the website or the product you accept these terms. If you do not accept them, do not use the service.

2. What Harvinfra provides

Harvinfra provides a hosted application that tracks running hours, predicts service timing, suggests reallocation and keeps compliance records for heavy equipment fleets. The service is delivered on a subscription basis with plans described on the pricing page.

3. Accounts

You are responsible for keeping account credentials confidential and for the activity of users you invite to your account. Notify us immediately if you suspect an account has been compromised.

4. Acceptable use

  • Do not attempt to access another account or its data.
  • Do not upload unlawful content or attempt to break the service.
  • Do not use the service to store personal information about equipment operators beyond what the audit trail requires.
  • Do not resell access to Harvinfra without a written reseller agreement.

5. Your data

Fleet operational data captured in the product belongs to you. Harvinfra processes it strictly to deliver the service. You can export the data in CSV or PDF at any time during an active subscription.

6. Fees and billing

Subscription fees are set out on the pricing page or in a signed order form. Fees are billed monthly or annually as agreed. Invoices are payable within the agreed net terms. Late fees or service suspension may apply on overdue invoices.

7. Term and termination

Monthly plans run month to month. Annual and multi year plans run for the agreed term. Either party can terminate for material breach after 30 days of written notice if the breach is not cured. On termination we return or delete your operational data on your written instruction.

8. Availability

We work to keep the service available and continuously improved. Scheduled maintenance is announced in advance. Enterprise plans include a service level commitment specified in the order form.

9. Predictions are guidance

The predictive maintenance and allocation features are decision support tools. They are informative, not directive. Site supervisors and fleet managers are responsible for final operational decisions, including whether to service or move a unit.

10. Warranties

We provide the service with reasonable skill and care. We do not warrant that the service is uninterrupted, error free, or fit for a particular purpose beyond the capabilities described in the documentation. Statutory rights that cannot be excluded are not affected.

11. Limitation of liability

To the extent permitted by law, neither party is liable for indirect or consequential loss. Aggregate liability under these terms is capped at the fees paid in the twelve months before the event giving rise to the claim.

12. Confidentiality

Each party will protect the other party's confidential information with the same care as it applies to its own, and no less than reasonable care.

13. Governing law and disputes

These terms are governed by the laws of the jurisdiction where Harvinfra is registered. The competent courts of that jurisdiction have exclusive jurisdiction over disputes, subject to any mandatory consumer protection laws that apply.

14. Changes

When these terms change materially, we will notify the primary contact on active accounts. Continued use of the service after a change constitutes acceptance of the updated terms.
